5.5.3 Consequences of breaking a PSPO

The action available for local authorities is to prosecute offenders for breach of the orders. Maximum consequence for breaching PSPO or a Dog Control Order is level 3 on the standard scale, which is currently £1000. Successful prosecution will result in a criminal conviction.

The Fixed Penalty Notice that we issue is a chance for an offender to discharge their liability for prosecution. They are not breaking any laws if they chose not to pay it. They do not legally have to. If they pay it the matter is resolved, if not then we provide the prosecution files for the local authorities.

The local authority sets the amount but a PSPO cannot be more than £100.
